AF Filed PIL on Fundamental Child Rights and Juvenile Justice at High Court Tulsipur Butwal Bench
The petition seeks to protect the rights of children held at the Child Reform Home (CRH) Rupandehi and improve the overall juvenile justice system in Nepal. The Ministry of Women, Children and Senior Citizens, the Ministry of Home Affairs, the Child Reform Home Rupandehi, and the District Police Office Rupandehi are named as respondents in the case.
The writ petition was jointly filed by a team of legal professionals and human rights advocates, including AF's Lumbini Province Senior Coordinator Advocate Basanta Gautam, Coordinator Advocate Indira Acharya, Senior Advocate Sunil Kumar Shrestha, representatives from INSEC, and other lawyers.
The petition details the inadequate conditions at the CRH Rupandehi, stating that the facility's infrastructure is in a deplorable state and currently houses 90 juveniles without providing them with minimum necessities. These children are reportedly suffering from skin diseases and eye problems, and are also denied their fundamental rights to education and recreation.
The petitioners urge the court to issue a verdict requiring the respondents to build proper infrastructure and mechanisms to uphold child rights. They further request the court to mandate the planning and implementation of activities that benefit the children residing at the CRH.
A preliminary hearing for the case is scheduled for 13 June 2024.
