Policeman Rapes a Woman : FIR Lodged
25 October 2011. Area Police Office (APO), Kakadbhitta of Jhapa district registered an FIR on rape in 20th October against a policeman accused of torturing and raping Radha BK (name changed), 47, at 11 pm in 14th October. Lawyers representing Advocacy Forum (AF) helped the victim in preparing and lodging the FIR.

DPO Dailekh Denies Registering FIR on Rape Case
30 September 2011. The District Police Office (DPO) of Dailekh has today refused to register the FIR of a rape case that occurred during the conflict and has endorsed it citing that it has been brought after crossing the limitation period. Sita Rana (name changed), a rape victim in the hands of RNA personnel
including the then lieutenant Jibesh Shah and three other unidentified
army men during the conflict, had attempted to register FIR for prompt
investigation.

SC Issues Directives to Review Quasi-judicial power of CDO
30 September 2011. The Supreme Court on 22 September 2011 issued a directive order in the name of the government to review the quasi-judicial power granted to the CDO by various laws including the Public Act 1970 and the Arms and Ammunition Act 1962. Under these laws the CDO is authorized to hear criminal cases. Challenging this jurisdiction of the CDO, Advocacy Forum (AF) had filed a writ petition on 31 Dec 2009.

Torture in Nepal and the role of NPM
27 September 2011. Expressing their views on the necessity of effective mechanism to prevent torture and other ill-treatment in Nepal, participants pointed out a glaring need to strengthen the existing networks working to combat the systematic practice of torture in Nepal. The view to the effect was expressed during a panel discussion jointly
organised by Advocacy Forum(AF), APT, OHCHR-Nepal and INSEC in the
capital on 23 September 2011. "Torture in Nepal is a very problematic
issue. The trend of torture was significantly high during the conflict
and is still systematically practised at present too. So a lot of cases
relating to torture should to raised" said, AF Chairperson Ms. Mandira
Sharma.

Torture Compensation Case filed against Police
26 September 2011. Seeking compensation to victim and departmental action against the perpetrators Mr. Bharat Sharma, 30, temporarily living in Tahachal, Kathmandu has filed a torture compensation case against Area Police Office, Chagal and Area Police Office, Bhagwanpau, Kathmandu under Torture Compensation Act – 1996 on 25 September 2011. He was arrested on 21 August 2011 on the suspicion of stealing money and gold from his neighbor Dhan Bahadur Magar's apartment in Tahachal on 9 August 2011. After his arrest he was taken to APO, Chagal in Tahachal Kathmandu where he was reportedly handcuffed and tortured for about 3, 4 hours by beating him with sticks. During the inquiry he was reportedly inserted a stick through his handcuffed elbows and bended knees, propped his legs up and beat with sticks on the soles of his feet for about 60, 65 times. Likewise, he was forced to do sit ups and downs by catching his ears.

Custodial Death Victim Barai's Family received Monetary Support
19 September 2011. The family members of Dharmendra Barai, 15, a permanent resident of Gonaha VDC-2, Puraini, Rupandehi district, who died in an unusual circumstance in police custody at Khajuriya Police Station in Rupandehi district at around 12.30 in the night on 03 July 2010, have received monetary support of NRs. 1, 50, 000/- (one hundred fifty thousand) by the District Administration Office, Rupandehi in September 13, 2011.

DPO Jhapa Registers FIR
19 September 2011. The District Police Office (DPO) of Jhapa today finally responded to the mandamus order of the Appellate Court of Ilam issued on 20 April 2010 in which the court had ordered the DPO to register the FIR and initiate prompt investigation vis-à-vis the arrest and subsequent extra-judicial execution of Man Bahadur Rai on 20 September 2002, and of Sunil Rajbanshi on 9 January 2004. Torture Victim File Case against Alleged Police Officers
6 September 2011. Accusing police officers of inflicting severe torture during a criminal investigation, torture victim Mr. Bablu alias Nijamuddin Sekh, a resident of Nepalgunj Municipality – 16, Belaspur, Banke district has filed a case against some police officers. On 6 September 2011, victim Sekh filed the case at District Court, Banke demanding maximum punishment against the perpetrators under Nepal Police Regulation - 2049 and maximum torture compensation to victim under Torture and Compensation Act – 2053, Section 6 (1).

Torture Victim Jailbirds Acquitted after more than Two Years
5 September 2011. Bhutanese refugees Ms. Suk Maya Subba, Ms. Dolma Tamang (died in jail on 05 July 2011), Mr. Nar Bir Rai, Mr. Janga Bahadur Rai, Mr. Jari Lal Rai and Mr. Jas Bahadur Rai, who were arrested on 21 April 2009 on suspicion of involving in the murder of another Bhutanese refugee Shanti Ram Nepal, are released after they were found innocent. On 04 September 2011, after the final hearing on the case District Court, Jhapa acquitted them from the accusation. Deciding the allegation against the accused could not be established, the single bench of Justice Ramesh Raj Pokhrel gave the verdict to release them.
