Conflict victims again moved to Supreme Court against the TRC Act

3 June 2014: Conflict victims have challenged the lately enacted transitional justice law on grounds that it infringes international human rights law and a ruling of the Supreme Court of 2 January 2014. Altogether 234 victims have lodged a petition demanding to amend the sections that chiefly aim at granting amnesty and forced reconciliation.

The victims have also challenged the formation of the proposed Truth and Reconciliation Commission (TRC) saying that it has been conundrum with problems. They have demanded the amendment of the Sections 13, 22, 24, 25, 26 and 29. They claimed that the government authorities have been reluctant in implementing the Supreme Court orders and so, asked for the mandamus order to the authorities, including Office of the Prime Ministers and Council of Ministers, the Ministry of Law and Justice, the Ministry of Peace and Reconstruction, the Legislature Parliament and the Office of the Attorney General.

Right after the Legislature Parliament passed the bill of TRC into law, the national and international actors, including conflict victims and human rights communities raised serious concerns pointing the flaws that are inherent in the Act. The victims also submitted memorandum to the Office of the President before the Act got the Presidential assent.

The victims claim that they are compelled to move to the court, as they were completely ignored from their voices getting heard.
