Nepalgunj High Court Issues Order to Provide Update about Education in Jayendu CCH
On 20 February 2024, the division bench of Judges Tanka Prasad Gurung and Basanta Raj Poudel issued the order. The bench has ordered to submit the current progress about the education status in the school approved for juveniles kept in the Jayendu CRH in Banke district.
Earlier, Advocacy Forum-Nepal (AF)'s Lawyer Basanta Gautam, Senior Advocate Sunil Kumar Shrestha, Advocates Lok Bahadur Shah, Bikash Acharya, Bal Bahadur Chand, Bishwajit Tiwari, Kewal Singh Tharu and INSEC Officer Binod Pandey had jointly filed a petition on 31 July 2023 to the High Court requesting to issue orders including mandamus to Jayendu CRH to provide the update about the education status. The petition mentioned that the Ministry of Education had sent a letter on 8 August 2022 with the decision to operate a school in the CRH. Since the CRH had not operated any school event after a year, the petitioners had moved the court requesting the order.
Nepal's laws and international conventions which Nepal is party to have ensured the juveniles' right to education. All 248 juveniles housed in Jayendu CRH have been deprived of education due to the lack of school. Earlier a group of lawyers had filed a writ petition to issue an order against the government to operate a school in Jayendu CRH.
